1. Terms and Conditions
The material on TELEHOP's website (the "Site"), which may include text, images, audio clips, video clips, software and other materials (the "Content"), are provided by TELEHOP for informational purposes only. By accessing the Site or downloading any Content, you agree to be bound by the terms and conditions set out below ("Terms and Conditions"). If you do not agree to these terms and conditions, do not access the Site or download any Content.
2. General Disclaimer
TELEHOP intends for the Content on the Site to be accurate and reliable, however, since the Content has been complied by TELEHOP from a variety of sources, it is provided to you "as is" and "as available". You must abide by all copyright notices, information and restrictions contained in any Content on or accessed through the Site, and maintain such notices in the Content.

The TELEHOP logo is a trademark of TELEHOP COMMUNICATIONS LTD. or its related companies, which may be registered in Canada and other countries. Other TELEHOP product or service names or logos referenced in the Site are trademarks or registered trademarks of TELEHOP or its related companies. All other products, services and company names mentioned in the Site may be trademarks of their respective owners.
For a current list of trademarks and tradenames of TELEHOP and its related companies used on the Site, as well as trademarks and tradenames licensed to TELEHOP or its related companies by third parties, contact us. The absence of a product or service name or logo from this Site does not constitute a waiver of the trademark or other intellectual property rights of TELEHOP or its related companies concerning that name or logo. You may not use any trademark displayed on the Site without the written permission of TELEHOP or the relevant owner of the trademark.
6. Indemnity
You agree to defend, indemnify and hold TELEHOP and its related companies harmless from any and all liabilities, costs and expenses, including reasonable attorneys' fees, related to any violation of these Terms and Conditions by you or users of your account, or in connection with the use of this Site or the placement or transmission of any information or other materials on this Site by you or users of your account.
7. Territory
The TELEHOP site originates in Canada. TELEHOP's products and services are offered in TELEHOP's operating territory. Some products and services referred to on the Site may not be available in all parts of TELEHOP's territory. Consult your TELEHOP business office, listed in your local telephone directory, for information regarding the products and services which may be available to you in your area.
8. Changes
TELEHOP reserves the right to change or remove any Content from the Site, in whole or in part, at its sole discretion, at any time, without notice.
9. Miscellaneous
Telehop reserves the right in its sole discretion and without prior notice to suspend and/or terminate Customer's access to the Service at any time. These Terms and Conditions, including the TELEHOP Privacy and Security Policy, is a binding part of these Terms and Conditions. and other documents referenced herein, constitute the entire agreement between TELEHOP and you with respect to your use of this Site. TELEHOP's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. If any of the Terms and Conditions is determined to be void, invalid or otherwise unenforceable by a court of competent jurisdiction, such determination shall not affect the remaining provisions hereof. This Agreement shall be governed by and construed in accordance with the laws of the province of Ontario and the federal laws of Canada applicable therein. The parties have required that these Terms and Conditions and all related documents be drawn up in English.

10. Your Liability
On first using the services provided by TELEHOP COMMUNICATIONS LTD, you shall be deemed to have agreed and be bound to clauses 11 and 12 set out herein.
11. Charges and Payment
You shall pay all applicable service rates, usage charges and other amounts, fees and charges, if any, together with all applicable taxes that are indicated to you when you purchase the Services or otherwise relayed to you by TELEHOP COMMUNICATIONS LTD from time to time ("charges"). You are responsible for and shall pay all charges when due. If payment is not received by TELEHOP COMMUNICATIONS LTD within 30 days of the date it is due as indicated on your invoice you will be charged interest on the balance owing at a compound interest rate equal to 3% per month (42.58% per year), calculated and compounded monthly from the invoice date ("Late Payment Charge"). TELEHOP COMMUNICATIONS LTD may change the Late Payment Charge from time to time. If you question or dispute any Charge, you must do so within 30 days of the disputed invoice date; otherwise, you will be deemed to accept all Charges. Disputed Charges will be considered past due if TELEHOP COMMUNICATIONS LTD reasonably believes you are using the dispute to evade or delay payment.
12. Responsibility for Charges
You shall pay TELEHOP COMMUNICATIONS LTD for any and all expenses incurred in the collection of any monies owed by you to TELEHOP COMMUNICATIONS LTD. You further agree, for failure to meet your obligations, under this clause and, for breach of any of the provisions of this agreement, to compensate TELEHOP COMMUNICATIONS LTD, for any and all general and special damages that may arise from such breach with may include damages for loss of business opportunity, loss of earning potential and reduction of earning capacity, loss of income and any and all incurred expenses, including all legal expenses and disbursements, for the enforcement of your obligations with TELEHOP COMMUNICATIONS LTD.
13. Service Limitations
Please be advised you MUST inform Telehop if you move any or all of your phones. It is imperative that Telehop has the correct location for all of your VoIP phones. If you need to update your address information, please send an email with your name and telephone number for the phone you are moving and the updated address to provisioning@telehop.com. Please be advised these changes may take up to 48 hours.
Home Phone has certain limitations relative to enhanced 911 service that is available on most traditional telephone service. You acknowledge and understand that the Service is not a traditional Telephone Service. There are important differences between your regular land line Telephone service and the Service offering as set out in these Terms and Conditions.
When you dial 911 from your Home Phone, you will be transferred to an operator for assistance. The operator will have your municipal address on file as per our records and direct your call to the local authorities based on your municipal address. If your municipal address is not in the Area of Service, 911 service may not operate properly or may not be able to help you.
It is your responsibility to ensure we have your correct municipal address and if you move or change your municipal address to update your correct address by logging into your account on our website. If you are traveling with your Home Phone device, 911 service may not operate properly or may not be able to help you. From you regular landline phone when you dial 911, the operator knows your physical location and can send the authorities based on the location of the physical phone line. This is not the case with the Home Phone service. Telehop Home Phone customers can have service outages due to problems with their Internet Service Provider (ISP), Power failure, suspension of account due to billing or payment issues, and intermittent network failure. If there is a service outage, 911 service will not be functional.
YOU ACKNOWLEDGE AND AGREE THAT TELEHOP COMMUNICATIONS LTD, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS AND UNDERLYING CARRIERS, WILL NOT BE LIABLE FOR ANY INJURY, DEATH OR DAMAGE TO PERSONS OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY OUT OF, OR RELATING TO THE 911 SERVICE RELATED TO TELEHOP HOME PHONE AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS TELEHOP COMMUNICATIONS LTD (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND UNDERLYING CARRIERS) FOR ANY LIABILITIES, CLAIMS, DAMAGES, LOSSES AND EXPENSES, (INCLUDING REASONABLE LEGAL FEES AND EXPENSES) WHICH YOU MAY SUFFER OR INCUR, ARISING DIRECTLY OR INDIRECTLY OUT OF OR RELATING TO YOUR FAILURE TO OBTAIN.
14. General Terms of Service
You have read, understood and agreed in full and unequivocally to follow the above terms and conditions.
CCTS is an agency independent of the telecommunications industry, whose mandate is to resolve complaints of individual and small business retail customers about their telecommunications service. If you have a complaint about your services, including local or long distance telephone service, wireless telephone service or Internet service, you must first try to resolve it directly with your service provider. If you have done so and have been unable to reach a satisfactory resolution, CCTS may be able to help you, free of charge.
